Advice on patented claims

Hey all!

I understand this forum focuses on refining, but most of you seem pretty knowledgeable so hoping some advice might shake out.

I've been gold panning on and off since middle school, but only recently began reading about cyanidation and other extraction processes and found this forum. So much great info.

Recently my girlfriend and I began discussing buying some land and building a small getaway cabin. Some place we could go camping, do some hiking, just relax. It occurred to me, why not see if I can by land where there's gold? That got me looking at patented claims, mostly in Colorado. Does anyone here have thoughts on these? Advice? Good places to look for claims or pitfalls to be wary of?

I'm looking at places like:

Searching through the forum I didn't find too much pertaining to land on my scale. If there's a better site to discuss this I'm open for that too.

You can buy land that may have gold, but not get the mineral rights to that gold.

You can also buy mineral rights and not the land.

Beware of this when looking for land in known gold county.

If you find a spot you like, ask the seller or their, (or your), realtor about the mineral rights.
 
I'm aware of the rights vs land purchase bit. It's been an absolute pain figuring out which properties have which.
Do you have any advice on locating land with rights? Half the time I make a call the realtor has no clue what I'm talking about, yet advertised the lot as a mining claim.

If it's advertised as a mining claim but the sellers agent has no clue as to what that means, then my advise is to run away, quickly.


The only sure fire way to know if the land purchase includes any mineral rights is to hire a lawyer that speclizes in such things. Your run of the mill rubber stamp the dead at closing lawyer won't have what it takes to do the research you need.
